Hank establishes this Privacy Policy with the purpose of transparently informing Users of the website hosted at the following address: www.hank.brussels (hereinafter the “Site”) about how personal data is collected and processed by Hank. The term “User” refers to any user, whether an individual or a legal entity, who visits or interacts with the Site in any way. In this regard, Hank determines all the technical, legal, and organizational means and purposes of processing Users’ personal data.
Hank commits to taking all necessary measures to ensure that the processing of personal data complies with the Law of July 30, 2018, on the protection of individuals concerning the processing of personal data (hereinafter, “the Law”) and the European Regulation of April 26, 2016, on the protection of personal data of individuals with regard to the processing of personal data and the free movement of such data (hereinafter, “the Regulation”).
Hank is free to choose any individual or legal entity to process the personal data of users at its request and on its behalf (hereinafter the “Processor”). If applicable, Hank undertakes to select a Processor who provides sufficient guarantees regarding the technical and organizational security measures of personal data processing, in accordance with the Law and the Regulation.
The use of the Site by Users may involve the disclosure of personal data. The processing of such data by Hank, acting as the Data Controller, or by service providers acting on behalf of Hank, will comply with the Law and the Regulation.
Personal data will be processed by Hank, in accordance with the purposes mentioned below, through: the newsletter subscription form; sending surveys or forms; creating a customer account; an automated process; the use of cookies for smooth usage of Hank’s website;
In accordance with Article 13 of the Regulation, the purposes of processing personal data are communicated to the User and are as follows:
1. Ensure the best possible use of the platform for the user;
2. Ensure the execution and monitoring of services offered and agreed upon on the site (registrations, pre-orders, orders, deliveries, returns, refunds, complaints, outstanding, product recalls…);
3. Carry out marketing and promotional information activities after the prior consent of the User and until the revocation of this consent, such as sending promotions on Hank’s products and services or sending newsletters;
5. Respond to User inquiries;
6. Conduct statistics to improve the website, the services offered, and the internal operating organization;
7. Improve the quality of the website and products and/or services offered by Hank;
8. Allow for a better identification of User interests;
9. For displaying comments and ratings from Users on our products.
The User consents, during the visit and use of the Site, to Hank collecting and processing, in accordance with the modalities and principles described in this Privacy Policy, the following personal data: User information provided for contractual purposes and to enable the proper execution of their order, complaint, or any other mutual obligation. This information includes the name, first name, address, possibly the phone number, IBAN number, and relevant banking information for payment of their orders, complaints, or refunds, and more generally, any information voluntarily provided by the User, included in their customer account or in email exchanges between Hank and the User;

Regarding each of the User’s visits to the Site, the automatically collected information includes: A. IP address, browser type and model, time zone, operating system; B. All information regarding the pages the User has viewed on the site, including the URL, browsing time, viewed content, etc.
the User declares that they have read and given their consent freely, specifically, informed, and unequivocally to the processing of their personal data as described in this Privacy Policy. This consent pertains to the content of this Privacy Policy.
Consent is given through the affirmative action of the User checking the box linked to the Privacy Policy in the hyperlink. This consent is a necessary condition for performing certain operations on the Site or for allowing the User to enter into a contractual relationship with Hank.
Any contract between Hank and a User for the services and goods offered on the Site is subject to the User’s acceptance of the Privacy Policy. The User consents to the Data Controller processing and collecting, in accordance with the modalities and principles contained in this Privacy Policy, their personal data that they provide on the Site or in connection with the services offered by Hank, for the purposes indicated above.
The User has the right to withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
In accordance with Article 13(2) of the Regulation and the Law, the Data Controller only retains personal data for as long as is reasonably necessary to achieve the purposes for which they are processed. In any case, this duration is less than: fourteen months.
Personal data may be transmitted to employees, collaborators, subcontractors, or suppliers of Hank who provide adequate data security guarantees and collaborate with Hank in the marketing of products or the provision of services. They act under the direct authority of Hank and are responsible for collecting, processing, or subcontracting these data.
In all cases, the recipients of the data and those to whom these data have been disclosed comply with the content of this Privacy Policy. Hank ensures that they will process this data for the sole intended purposes, discreetly and securely.
In the event that data is disclosed to third parties for direct marketing or prospecting purposes, the User will be informed in advance so that they can express their consent to the use of this personal data.

a. Right of Access
In accordance with Article 15 of the Regulation, Hank guarantees the User’s right of access to their personal data. The User has the right to obtain access to these personal data as well as the following information:
– the purposes of the processing;
– the categories of personal data concerned;
– the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients established in third countries or international organizations;
– where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
– the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the Regulation, and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
The Data Controller may require payment of reasonable administrative costs for any additional copies requested by the User.When the User makes this request electronically (e.g., via email), the information is provided in a commonly used electronic format, unless the User requests otherwise. A copy of their data will be provided to the User no later than one month after receiving the request.
b. Right to Rectification
Hank guarantees the right to rectify and erase personal data to the user.
In accordance with Article 16 of the Regulation, incorrect, inaccurate, or irrelevant data can be corrected or erased at any time. The User must first make the necessary changes themselves from their user account or other means, unless these changes cannot be made independently, in which case the request can be made to Hank.
In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom personal data have been disclosed of any rectification of personal data, unless such communication proves impossible or requires disproportionate effort. The data controller provides information about these recipients to the data subject upon request.
c. Right to Erasure
The User has the right to obtain the erasure of their personal data in the cases listed in Article 17 of the Regulation.
When the Data Controller has made personal data public and is obliged to erase it in accordance with the preceding paragraph, the Data Controller, taking into account available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other data controllers processing the personal data that the data subject has requested erasure by such data controllers of any links to, or copy or replication of, that personal data.
The two preceding paragraphs shall not apply to the extent that processing is necessary:
– for exercising the right of freedom of expression and information;
– for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
– for the establishment, exercise or defence of legal claims. In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom personal data have been disclosed of any erasure of personal data or restriction of processing carried out, unless such communication proves impossible or requires disproportionate effort. The data controller provides information about these recipients to the data subject upon request.
d. Right to Restriction of Processing
The User has the right to obtain the restriction of processing of their personal data in the cases listed in Article 19 of the Regulation.
In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom personal data have been disclosed of any restriction of processing carried out, unless such communication proves impossible or requires disproportionate effort. The data controller provides information about these recipients to the data subject upon request.
e. Right to Data Portability
In accordance with Article 20 of the Regulation, Users have the right to receive their personal data concerning them from Hank in a structured, commonly used, and machine-readable format. Users have the right to transmit this data to another data controller without hindrance from Hank in cases provided for by the Regulation.
When the User exercises their right to data portability pursuant to the preceding paragraph, they have the right to have personal data transmitted directly from one data controller to another, where technically feasible.
The exercise of the right to data portability is without prejudice to the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller.
The right to data portability shall not adversely affect the rights and freedoms of others.
f. Right to Object and Automated Individual Decision-Making
The User has the right to object to the processing of their personal data at any time due to their particular situation, including automated data processing carried out by Hank. In accordance with Article 21 of the Regulation, Hank will no longer process personal data unless there are compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the User or for the establishment, exercise, or defense of legal claims.
When personal data is processed for direct marketing purposes, the User has the right to object at any time to the processing of personal data concerning them for such marketing, including profiling to the extent that it is related to such direct marketing.
When the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.
g. Right to Lodge a Complaint
The User has the right to lodge a complaint regarding the processing of their personal data by Hank with the Data Protection Authority, which is competent for the Belgian territory. Further information can be found on the website:

Hank strongly advises individuals exercising parental authority over minors to promote responsible and secure use of the Internet. The Data Controller cannot be held responsible for collecting and processing information and personal data from minors under the age of 16 whose consent is not effectively covered by that of their legal parents, or for incorrect data, including age, provided by minors. Under no circumstances will personal data be processed by the Data Controller if the User specifies that they are under 16 years of age.
Hank is not responsible for the loss, corruption, or theft of personal data caused, in particular, by the presence of viruses or as a result of cyberattacks.
The Data Controller implements organizational and technical measures to ensure an appropriate level of security for the processing and collection of data. These security measures depend on the implementation costs in relation to the nature, context, and purposes of the processing of personal data. The Data Controller uses standard IT encryption technologies during the transfer or collection of data on the Website.
Hank reserves the right to modify this Privacy Policy to comply with legal obligations. Users are therefore encouraged to regularly consult the Privacy Policy to be informed of any changes and adaptations. Such modifications will be displayed on the Website or sent by email for the purpose of enforceability.
This Privacy Policy is exclusively governed by Belgian law. Any dispute shall be brought before the courts of the judicial district where Hank’s registered office is located.
