Terms and Conditions of Use

These general terms and conditions of use (hereinafter referred to as “Terms of Use”) apply to any visit or use of the Platform and its information by an internet user (hereinafter referred to as the “User”).

By visiting or using the Platform, the User acknowledges having read these Terms of Use and expressly accepts the rights and obligations mentioned therein. Exceptions to the provisions of the Terms of Use may exceptionally be made through a written agreement. These exceptions may involve the modification, addition, or removal of clauses to which they relate and have no impact on the application of other provisions of the Terms of Use.

We reserve the right to modify our Terms of Use at any time, without prior notification, but we commit to applying the provisions that were in effect at the time you used our Platform.

a. Access and Navigation

We take all reasonable and necessary measures to ensure the proper functioning, security, and accessibility of our Platform. However, we cannot provide a guarantee of absolute operability, and therefore, our actions should be considered as subject to a duty of care. Any use of the Platform is always at the User’s own risk. Therefore, we are not responsible for any damages that may result from possible malfunctions, interruptions, defects, or harmful elements present on the Platform. We reserve the right to restrict access to the Platform or interrupt its operation at any time without the obligation of prior notification.

b. Content

Hank Studio SNC largely determines the content of the Platform and takes great care of the information provided on it. We take all possible measures to maintain our Platform as complete, accurate, and up-to-date as possible, even when the information on it is provided by third parties. We reserve the right to modify, supplement, or delete the Platform and its content at any time, without being held responsible. Hank Studio SNC cannot provide an absolute guarantee regarding the quality of the information on the Platform. Therefore, this information may not always be complete, accurate, sufficiently precise, or up-to-date. Consequently, Hank Studio SNC cannot be held responsible for direct or indirect damages that the User may incur due to the information on the Platform. If certain content on the Platform violates the law or the rights of third parties or goes against morality, we ask you to inform us as soon as possible via email so that we can take appropriate measures.

Any downloads from the Platform always occur at the User’s own risk. Hank Studio SNC cannot be held responsible for potential direct or indirect damages resulting from these downloads, such as data loss or damage to the User’s computer system, which are entirely and exclusively the User’s responsibility.

c. Services Reserved for Registered Users
c.1. Registration
Access to certain services requires User registration. Registration and access to the services of the Platform are exclusively reserved for legally capable individuals who have completed and validated the online registration form on the Platform, as well as these Terms of Use. During registration, the User agrees to provide accurate, truthful, and up-to-date information about themselves and their personal details. The User must also regularly verify the data concerning them to ensure its accuracy.

The User must provide a valid email address, to which the Platform will send a confirmation of their registration for its services. An email address cannot be used multiple times for registration for the services. Any communication made by the Platform and its partners is therefore deemed to have been received and read by the User. The User thus undertakes to regularly check the messages received at this email address and, if necessary, to respond within a reasonable timeframe. Only one registration is allowed per individual.

The User is assigned an identifier that allows them to access a space reserved for them (hereinafter referred to as the “Personal Space”), in addition to entering their password. The identifier and password can be changed online by the User in their Personal Space. The password is personal and confidential, and the User agrees not to disclose it to third parties. Hank Studio SNC reserves the right, in any case, to refuse a registration request for the Platform’s services in the event of the User’s non-compliance with the Terms of Use.

c.2. Unsubscribing
A regularly registered User may request their unsubscribing at any time by visiting the dedicated page in their Personal Space. Unsubscribing from the Platform will be effective after the User has completed the designated form for this purpose, within the following period: 30 days.

d.User-Generated Content
The User commits to complying with the applicable laws through each of their publications on the Platform. They will be particularly mindful of the interests of third parties, offensive content, and content that may be contrary to public order or morals. The User remains responsible for any content posted on the Platform. The Platform may exercise moderation over any publication and refuse to upload content without the need for justification. Likewise, content published by a User may be modified or removed without reason or delay. By publishing on the Platform, the User grants Hank Studio SNC, free of charge and on a non-exclusive basis, the right to represent, reproduce, adapt, modify, distribute, and broadcast, directly or indirectly, and on any medium and worldwide, the published content.

 The Platform may contain links or hyperlinks to external websites. Such links do not automatically imply that there is a relationship between Hank Studio SNC and the external website, or even that there is an implicit agreement with the content of these external sites. Hank Studio SNC has no control over external websites. Therefore, we are not responsible for the safe and correct functioning of hyperlinks and their ultimate destination. As soon as the User clicks on the hyperlink, they leave the Platform. Therefore, we cannot be held responsible for any subsequent damage.

 The structure of the Platform, as well as the texts, graphics, images, photographs, sounds, videos, databases, computer applications, etc., that compose it or are accessible through the Platform are the property of the publisher and are protected as such by the laws governing intellectual property.

Any representation, reproduction, adaptation, or partial or total exploitation of the contents, trademarks, and services offered by the Platform, by any means whatsoever, without the prior, express, and written authorization of the publisher, is strictly prohibited, except for elements expressly designated as free of rights on the Platform.

The User of the Platform is granted a limited right to access, use, and display the Platform and its content. This right is granted on a non-exclusive, non-transferable basis and can only be used for personal and non-commercial purposes. Without prior written consent, Users are not authorized to modify, reproduce, translate, distribute, sell, or communicate to the public, in whole or in part, the protected elements. Users are prohibited from introducing data onto the Platform that would modify or be likely to modify its content or appearance.

 The personal data provided by the User during their visit or use of the Platform are collected and processed by Hank Studio SNC exclusively for internal purposes. Hank Studio SNC assures its users that it attaches the utmost importance to the protection of their privacy and personal data and is committed to communicating clearly and transparently on this matter at all times.

Hank Studio SNC commits to complying with the applicable legislation, namely the Law of December 8, 1992, regarding the protection of privacy with regard to the processing of personal data, as well as the European Regulation of April 27, 2016, concerning the protection of individuals with regard to the processing of personal data and the free movement of such data. The personal data of the User is processed in accordance with the Privacy Charter available on the Platform.

 These Terms of Use are governed by Belgian law. In the event of a dispute and in the absence of an amicable agreement, the dispute shall be brought before the courts of the judicial district where Hank Studio SNC has its registered office.

 Hank Studio SNC reserves the right to modify, expand, delete, limit, or interrupt the Platform and associated services at any time without prior notice and without incurring liability. In the event of a User’s violation of the Terms of Use, Hank Studio SNC reserves the right to take appropriate measures for sanctions and remedies. Hank Studio SNC notably reserves the right to temporarily or permanently deny the User access to the Platform or our services. These measures may be taken without specifying a reason and without prior notice. They cannot hold Hank Studio SNC liable or give rise to any form of compensation. The illegality or total or partial nullity of a provision in our Terms of Use will have no impact on the validity and application of the other provisions. In such a case, we have the right to replace the provision with another valid provision of similar scope.
